These terms govern the use of the swypix mobile app and this website. By downloading or using swypix you agree to these terms.
1. Provider
The provider is Maximilian Rechenauer, Am Stadtrand 43, 8600 Dübendorf, Switzerland. Contact: support@swypix.com.
2. Service description
swypix is a camera-roll cleanup app. It shows photos and videos from your device, lets you mark items for deletion via a swipe gesture, and deletes marked items — after your confirmation — through your device's system interface. We grant you a non-exclusive, non-transferable right to use the app for the duration of your usage.
3. Free and paid features
The app's base functionality is free. The Pro version (auto-renewing subscription) is available via the Apple App Store or Google Play. Current prices are visible in the store before purchase. Billing is handled by Apple or Google.
4. Auto-renewal and cancellation
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the period in your App Store account. Cancellation must be performed through your store's subscription management — we cannot do this for you. Fees already paid are not refunded on a pro-rata basis.
5. User responsibilities
You use swypix at your own risk. In particular, you are responsible for not deleting photos you wish to keep. We strongly recommend backing up your camera roll before first use (iCloud Photos, Google Photos, or a local backup).
6. Liability
We are liable without limitation only for intent and gross negligence and for damages resulting from injury to life, body, or health. For simple negligence we are liable only for breach of material contractual duties and only up to the foreseeable, contract-typical damage. Liability for lost photo data is — to the extent legally permissible — excluded, because actual deletion only occurs after your final confirmation via the operating system.
7. Changes
We may amend these terms if functionality or legal requirements change. We announce material changes at least 30 days in advance in the app or by email.
8. Governing law and jurisdiction
Swiss law applies exclusively, excluding the UN Convention on the International Sale of Goods and conflict-of-law rules. The place of jurisdiction is — to the extent legally permissible — Dübendorf, Switzerland. Mandatory consumer protection provisions of your country of residence remain unaffected.
9. Dispute resolution
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
10. Additional terms for the Apple App Store version
The following clauses apply additionally if you obtained swypix through the Apple App Store (per Apple's «Schedule 2 — Additional Terms»): (a) Parties: These terms are concluded solely between you and us. Apple Inc. is not a party to this agreement. (b) Scope of licence: You are granted a non-transferable licence to use swypix on Apple-branded devices that you own or control, subject to the App Store Terms of Service. (c) Maintenance and support: We, not Apple, are solely responsible for maintenance and support of swypix. Apple has no obligation to provide any maintenance or support services. (d) Warranty: We are solely responsible for any warranties — express or implied. Should the app fail to conform to any applicable warranty, you may notify Apple; Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no further warranty obligation. (e) Product and legal claims: Claims relating to the app (product defects, consumer protection, privacy, regulatory matters) must be addressed solely to us — not to Apple. (f) Intellectual property infringement: In the event that any third party claims the app infringes their intellectual property, we — not Apple — will be solely responsible for investigation, defence, settlement and discharge. (g) Export control: By using the app you represent that you are not located in a country subject to U.S. embargo and that you are not on any U.S. sanctions list. (h) Third-party beneficiary: Apple Inc. and its subsidiaries are third-party beneficiaries of these terms and are entitled to enforce them against you as third-party beneficiaries once you have accepted them.
11. Additional terms for the Google Play version
If you obtained swypix through Google Play, the Google Play Terms of Service apply additionally. Distribution occurs via Google LLC, but the contractual relationship regarding swypix Pro is between you and us. We, not Google, are responsible for swypix.
